South Dakota Bans Abortion
Today, the governor of South Dakota signed a bill into law banning abortion in the state except when the life of the mother is in danger.
South Dakota already has very few abortions. There is only one clinic in the entire state, and abortionists have to be flown in from Minnesota once a week to actually perform the abortions because no one in the state will do it.
With Mississippi poised to sign a similar law in the near future, once again we see how unfortunate it is to have a Supreme Court regulating an issue that our Constitution leaves to the people. Obviously, the people of South Dakota feel quite differently about abortion than those in Washington, D.C. When the people are not allowed to speak, but are told to suppress their ideas by lawyer elites, they get frustrated. And that's exactly what this bill is-a frustration bill.
But passing this, as much as I sympathize from a policy standpoint, is just plain stupid. Everyone who studies the issue knows that we are still one vote away from overturning Roe even if Roberts and Alito would do so, which is no given. So what will happen is this. There will be a pro-abortion frenzy to file the suit by groups like the ACLU and Planned Parenthood. Then the U.S. Federal District Judge will strike down the law because she is required to follow precedent. It will then go to the Court of Appeals, which will do the same thing. Then the Court will make the state of South Dakota pay the abortionists their lawyer's fees. And that will be the end of it.
Why would the pro-life movement possibly want to give the pro-abortion crowd more money? It's like a soldier rushing into battle with righteous zeal and a pitchfork. Iit's just plain stupid, no matter how commendable the motive.
